of the IBV founded in 1958
1. Paragraph: Name, seat, purpose, federation activity
§ 1 Name and seat of the federation
1. The federation bears the name: Internationaler Brauereikultur-Verband e.V. ( ~ International brewery culture federation), shortly : IBV
2. The federation has its seat in Stuttgart, F.R.Germany.
3. The IBV pursues exclusively and directly non-profit purposes in the sense of the paragraph "tax-privileged purposes" of the delivery order, it is active unselfishly and pursues not in first line self-economical purposes.
4. Means of the IBV may be used only for statutory purposes. The members receive no allowances from means of the federation.
5. No person may be favoured by outputs, which are not according to the purpose of the federation, or through disproportionately high reimbursement.
§ 2 Purpose of the federation
Purpose of the federation is it, to retain, to maintain and promote the area of the cultural property, that developed itself around the beverage BEER in most varied manifestations - in particular under the criteria
- history of beer
- literature about beer
- conveyances for beer
- containers for beer transports
- beer drinking containers
- beer advertising media
§ 3 Federation activity
1. The federation serves its federation purpose in particular by following activities:
a) Maintenance of the people friendship and the people communication in the context of the organization of international exhibitions, seminars and exchange meetings.
b) Publication of an international, periodically appearing federation magazine, multilingual in subranges .
c) Distinguishing personalities, who acquired themselves special services in the sense of § 2 of this Statute.
d) Operation of auxiliary -, support and information mechanisms in the
sense of § 2 of
this Statute.
e) Creating historical documents.
2. In the context of its activity the federation holds independent and free contacts to Authorities and federations, breweries and beer publishing houses.
§ 4 Federation language, federation right
1. The federation activity is handled in German language.
2. Area of jurisdiction is Stuttgart, F. R. Germany.
2. Paragraph: Membership and membership fees
§ 5 Acquisition of membership
1. Each fully competent natural person can become Member of the IBV.
Limited
competent persons require the consent of their guardian to membership
2. Legal entities can also become member.
3. The membership begins by joining the IBV.
4. The application for membership is to be submitted in writing.
5. The president decides on provisional accommodation.
6. The general meeting decides on accommodation.
7. The refusal of the accommodation by the general meeting is indisputable.
8. A requirement for accommodation does not exist.
§ 6 Rights and obligations of the members
1. Each member has the right
a) to participation at the federation-political will formation by discussion, filing of an application, votes and exercising the right to vote,
b) to get information by receiving the federation magazine,
c) to use the mechanisms offered by the IBV free of charge or against payment in Sense of § 3 (1) of this statute.
2. Each member has the obligation
a) to stand for the targets of the IBV, to recognize and consider the
statute and the statutory resolutions.
b) to pay determined membership fees in advance. With delay of the membership fees all rights rest, particularly in the sense of § 6 paragraph 1.
3. Members, who acquired themselves special services around the IBV, can be distinguished by Honorary membership. Suggestions are to be checked by the presidency, and to be submitted justified to the general meeting for decision. Honour members are noncontributory.
§ 7 Withdrawal of members
1. The withdrawal is permitted only by keeping a term of notice of four
weeks to the conclusion ofone
Calendar quarter.
2. The withdrawal is to be explained to the presidency in writing. To keep the term of notice (paragraph 2), a punctual acces of the withdrawal assertion to a member of the presidency is necessary.
3. The membership ends by death of the member.
§ 8 Exclusion of the members
1. Additionally the membership ends by exclusion.
2. The exclusion of the federation is permitted only in case of an important reason.
3. The general meeting decides on the exclusion upon the request of the presidency.
4. The presidency has to indicate his request to the member who can be excluded at least two weeks before the meeting.
5. A written statement which is received of the member is to be read at the general meetingthat decides on the exclusion.
6. The exclusion of a member becomes immediately effective by adoption of resolutions.
7. The exclusion is to be announced to the member immediately, if it was not present during adoption of resolutions.
§ 9 Cancellation of the membership
1. Additionally a member separates by cancellation of the membership of the IBV.
2. The cancellation of the membership takes place, if the member is in arriers with a quarter contribution and the membership fee is not fully paid even after a written reminder by the Treasurer, within 2 months after dispatching the reminder. The reminder is sent in writing to the adress of the member known by the IBV.
3. In the reminder must be referred to the forthcoming cancellation of the membership.
4. The reminder becomes effective with its sending off.
5. The cancellation of the membership takes place via resolution of the presidency and is not to be told to the member concerned.
§ 10 Membership fees
1. A membership fee is to be paid.
2. The general meeting decides on its amount.
3. The membership fee is to be paid annually in advance.
4. If the entry takes place before 30th June, the full membership fee is to be paid; entering after 1st July, the half fee plus the complete membership fee of the following year is to be paid.
5. A single admission fee including IBV-membership card is to be paid, the general meeting decides on the amount..
6. In a justified case the presidency can decide on a reduced membership fee.
3. Paragraph: Organization, organs
§ 11 Structure
1. The IBV is a federal association.
2. In the case of need spatial subdivisions can be made; the general meeting regulates details.
§ 12 Organs of the federation
Organs of the IBV are
a) the general meeting §§ 13 to 17
b) the presidency §§ 18 and 19
§ 13 General meeting
1. The general meeting is the most important organ of the IBV.
2. The general meeting is to be convened annually once, if possible in the first five calendar months. It is to be convened also if the tenth part of the members declares in writing their wish to convene a general meeting by specificating the purpose and the reasons it requires.
3. Each member or the presidency can place requests for the general meeting. Requests must be submitted at the latest three weeks before the general meeting. The general meeting decides on permission of too late submitted requests.
4. At the general meeting the presidency has to submit
- the annual report and
- the annual cash report about the recent financial year. The financial
year is the calendar year.
5. The general meeting decides on the discharge of the presidency.
6. In election years
- the presidency in the sense of § 18 (1) and
- two cash controllers (§21 exp. 1) are to be elected.
7. The general meeting decides on membership requests of the report period.
8. To realize the general meeting the "standing orders for the general meeting" is valid.
§ 14 Form of the convention
1. The general meeting is convened by the presidency in writing by keeping a period of six weeks.
2. The period is considered as kept, if meeting place, time and the
subject of the adoption of resolutions
(agenda) are published in the edition of the federation magazine preceding
the general meeting.
3. The period begins with the day of dispatching the federation magazine
to the last well-known
address of the members.
§ 15 Quorum
1. Each correctly appointed general meeting is resolution able.
2. For adoption of resolutions about the dissolution of the federation the presence of two thirds of the members is necessary.
3. If an adoption of resolutions about the dissolution of the IBV convened general meeting after Paragraph 2 is not resolution able, then before flow of 4 weeks since the meeting day a further general meeting with the same agenda is to be convened.
The further meeting may take place at the earliest 2 months after the first meeting day, but has to take place at the latest 4 months after the first meeting day.
4. A note about the relived resolution ability (paragraph 5) has to be included to the invitation to the further meeting..
5. The new meeting is resolutionable without considerating the number of the present members of the association.
§ 16 Adoption of resolutions
1. It is voted by hand sign. On request of at least 20 % of the present members it is to be voted in writing and secretly on the respective item of the agenda.
2. During the adoption of resolutions the simple majority decides.
3. To an adoption of resolutions, which contains a modification of the statute, a majority of three quarters is necessarily.
4. For the modification of the purpose of the IBV (§ 2 of the statute) the agreement of all members is necessarily; the agreement of the absent members must take place in writing.
5. For adoption of resolutions about the dissolution of the IBV a majority of four fifth is necessarily.
6. After each adoption of resolutions the required majority is to calculate only after the number of positive and negative votes. Paragraph 4 remains unaffected of this.
§ 17 Certification of the meeting resolutions
1. A record is to be made about the resolutions seized in the meeting.
2. The record is to be signed by the leader of the meeting and the keeper of the minutes too.
3. Each IBV member is entitled to see the minute.
4. Who makes the invalidity of a correctly recorded resolution valid, has to prove the assertion for invalidity.
§ 18 Presidency
1. The presidency consists of
- the president
- the 1st and 2nd Vice-president
- the treasurer
2. The presidency is elected by the general meeting for a period of office of five years; one re-election is possible.
3. Executive committee in the sense of § 26 BGB (BGB=German Civil
Code Law) are the president and the two vice-presidents.
Each member of the committee represents individually.
In the interior relation the vice-presidents are only authorized, in the order of their duty, to take their right of representation, if the president is absent.
The right of representation of the executive committee is limited in interior relation the way that with all acquisition business and for all orders over properties and property-same rights, as well as for the accommodation of a credit over 1 000.00 DM (in words: one thousand) the agreement of the general meeting is necessary.
4. The duty of a member of the presidency ends with its separation from the IBV.
5. Several duties for presidency cannot be combined in one person.
6. If a presidency member separates during the period of office, the presidency names a substitute. A by-election at an extraordinary general meeting must be held, if - after members of the presidency separated - not at least two elected members stay in duty, or if more than half of the members separate at the same time.
7. Substitute appointments and by-elections are valid in each case just
for the remaining period of office for that
current legislative period.
§ 19 Management by the presidency
1. The presidency leads honorary the business of the IBV.
2. The president has the guideline authority for the fulfilment of the functions of the IBV.
3. The president is the chairman of the presidency.
4. The presidency is responsible for all affairs of the IBV, if the regulation is not reserved for the general meeting.
5. The IBV can maintain an office, which is subordinate to the supervision of the president.
6. For the execution of activities in the sense of § 3 of the statute the presidency can assign members.
7. The president
- convenes the presidency meeting , including a feed of a provisional
agenda and keeping a period of seven days - with special urgency three
days - ,
- leads the presidency of the presidency meeting.
8. A presidency meeting is resolutionable, if at least half of the presidency
members is present; it elects with simple majority; in case of equality
of votes
the vote of the chairman decides. If no secret vote is requested, decisions
take place by hand signs.
9. In urgent cases the president decides and acts in his own responsibility. The presidency is to be informed at the next presidency meeting.
10. A telephonic adoption of resolutions is permitted, if no presidency member contradicts to the telephonic adoption of resolutions.
11. A record is to be made about the resolutions seized in each presidency meeting. The record is to be signed by the leader of the meeting and the keeper of the minutes too. Each presidency member is entitled to achieve the minute.
4. Paragraph: Account system
§ 20 Account system
The treasurers leads the account business according to the principles of commercial trade.
§ 21 Cash controllers
1. The two cash controllers and the substitute cash controller are elected with the presidency for the same legislative period. They check the cash balance.
2. The inspection result is to be submitted to the president.
3. It is also their job to check the annual cash report.. They report the result to the general meeting and request the discharge of the presidency.
4. After the elected period the re-election of one cash controller is possible.

§ 22 Federation magazine
The IBV informs its members by the federation magazine.
§ 23 Dissolution of the IBV
1. the IBV can be dissolved by resolution of the general meeting.
2. The general meeting determines the entitled persons.
3. In the case of dissolution or removal of the IBV the fortune is to
use for tax-privileged purposes. Resolutions about the future use of the
fortune may only
be executed after consent of the tax office.
4. The liquidation is executed by the presidency.
